1. About these terms

These Terms of Use apply to people who visit getclubcards.com or join a loyalty card through Clubcards ("you"). Clubcards is operated by Juan Pablo Vengoechea Jacome, doing business as Clubcards ("Clubcards", "we", "us"). By joining a card or using our website you agree to these terms and to our Privacy Policy. Businesses that use Clubcards agree to our separate Business Terms of Service.

2. Who can join

You must be at least 18 years old and live in the United States to join a card. You agree that the information you give is accurate and that the card is for your own use.

3. The loyalty program belongs to the business

• Each card is offered by a participating business, which decides the rewards, how many visits earn a reward, and any other conditions. The business is responsible for honoring its rewards and for its products and services.
• The business may change, pause or end its program at any time, which can affect stamps you have collected. Questions or disputes about a reward should go to the business first.
• Clubcards provides the technology that runs the card. We are not a party to the reward offer and are not responsible for a business's decisions, products or services.
• Stamps and rewards have no cash value, cannot be sold or transferred, and cannot be exchanged for money, unless the business says otherwise in writing.

4. Apple Wallet and Google Wallet

Cards can be added to Apple Wallet or Google Wallet. Those apps are provided by Apple and Google under their own terms. Your phone decides when to show lock-screen suggestions and notifications, so we cannot guarantee that they appear. Keep your card link private: anyone with it can open your card.

5. Fair use

You agree not to create cards in someone else's name, collect stamps you did not earn, copy or alter cards or codes, interfere with or overload the service, try to access accounts or data that are not yours, or use the service for anything illegal. We or the business may cancel a card that is used fraudulently.

6. Promotions

If you choose to receive offers, the business's promotions appear on your card. You can turn them off anytime on your card page. Clubcards does not text or call you.

7. Our content

The Clubcards name, logo, website and software belong to us or our licensors. Business names, logos and rewards belong to each business. You may not copy or reuse them except to use your card.

8. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will always be available or error-free, or that any reward will be offered or honored.

9. Limitation of liability

To the fullest extent permitted by law, Clubcards will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost rewards, profits or data. Our total liability for any claim relating to the service is limited to fifty U.S. dollars (US$50). Some states do not allow these limits, so they may not apply to you.

10. Ending your card

You can stop using your card anytime by deleting it from your Wallet and asking us to delete your information. We may suspend or end access to the service if these terms are broken or if a business stops using Clubcards.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, please contact us at support@getclubcards.com so we can try to resolve it informally within 30 days. Any dispute that is not resolved will be handled in the state or federal courts located in Florida, and you and we agree to their jurisdiction. Either party may bring a claim in small claims court where it qualifies.

12. Changes

We may update these terms. The effective date at the top shows the latest version. Continuing to use your card after a change means you accept the updated terms.
